The Allahabad High Court ICJS email instructions have now been formally implemented, marking a decisive shift in how criminal case instructions reach the High Court.
Justice Arun Kumar Singh Deshwal, speaking for the Bench, made it clear that liberty cannot wait on paperwork when technology is already available but underused.
Allahabad High Court ICJS Email Instructions Replace Manual Process
Under the Allahabad High Court ICJS email instructions, the Director General of Police, Uttar Pradesh, has been directed to ensure that instructions in bail and other criminal matters are sent directly to the Government Advocate through email.
The Court found the existing system archaic, time consuming, and wasteful of public resources.
At present, bail notices travel through a long chain involving police pairokars, district offices, and investigating officers.
The Court observed that this physical movement delays bail hearings by weeks, even though the issue directly concerns personal liberty under Article 21.
ICJS Integration Highlighted As Long-Pending Reform
The Allahabad High Court ICJS email instructions came during an in-depth discussion with senior police and technical officers on the functioning of the Interoperable Criminal Justice System.
Officials explained that ICJS works on the principle of One Data One Entry, enabling seamless access between police, courts, prisons, and forensic departments.
The Court noted that while district courts can access FIRs and charge sheets on CCTNS, they still lack access to criminal history data maintained with DCRB and SCRB.
As a result, prosecutors take over two weeks to collect information that could otherwise be accessed within hours through proper ICJS integration.
Stopgap Email Mechanism Ordered Pending ICJS 2.0
Although ICJS 2.0 is expected to roll out in the coming months, the Bench refused to let systemic delays continue.
As an interim arrangement under the Allahabad High Court ICJS email instructions, the DGP has been ordered to route instructions in bail and criminal matters to the Joint Director Prosecution at the High Court through the official email ID.
The Joint Director Prosecution informed the Court that his office is prepared to assist Government Advocates and AGAs but is critically understaffed.
A direction was issued to the Chief Secretary of Uttar Pradesh to immediately provide five additional staff members for effective functioning.
Wider ICJS Integration Ordered Across Departments
The Court went beyond email instructions and addressed the slow pace of ICJS implementation since 2009, despite substantial public expenditure.
Referring to statutory rules under the UP Gangsters Act and the Bharatiya Nagarik Suraksha Sanhita Rules, the Bench noted that electronic service of summons and uploading of gang charts remain ineffective due to poor integration.
The Chief Secretary has now been directed to nominate a senior IPS officer to oversee ICJS integration across departments, including prisons, forest authorities, and municipal bodies.
The Director General of the NCRB has also been directed to ensure the immediate and effective implementation in Uttar Pradesh.
Bail Matter Adjourned With Directions
In the case at hand, the bail application was adjourned to December 18 to enable the State to file a supplementary injury report.
Even while granting time, the Court reiterated that the Allahabad High Court ICJS email instructions must be followed without exception in future cases.
The Allahabad High Court ICJS email instructions send a clear signal that criminal justice administration must move at the speed of technology, not at the pace of files and foot travel.
